1. Who we are and what these terms cover

These Terms of Service ("Terms") are a contract between you and Street Cat, based in Lisbon, Portugal ("Street Cat", "we", "us"). They govern your use of the Street Cat language-learning service, delivered over WhatsApp or Telegram, with an optional website account for managing your cats and billing.

By starting a chat with Street Cat, taking the free trial, creating a web account, or purchasing a plan, you accept these Terms and our Privacy Policy.

2. What Street Cat is (and isn't)

Street Cat is an AI-powered language practice companion. You chat with an artificial-intelligence "cat" character in your target language via text and voice notes, over WhatsApp or Telegram.

Please understand:

• You are talking to an AI, not a person. The cat is a fictional character. Its voices are AI-generated.
• Language models make mistakes. Replies may occasionally be inaccurate, including language explanations. Street Cat is a practice tool, not a certified teacher, and does not provide professional, medical, legal, or financial advice.
• Street Cat is not an emergency or support service. If you are in crisis, please contact local emergency services or a helpline.
• Street Cat is an independent service and is not affiliated with or endorsed by WhatsApp, Meta, or Telegram. Your use of those platforms remains subject to their own terms.

3. Eligibility

You must be at least 16 years old (or the minimum age to use WhatsApp/Telegram in your country, if higher) and legally capable of entering into this contract.

4. Your account

Your account is identified by your WhatsApp phone number or Telegram chat ID. If you create a free website account, it is identified by your email address, and can be linked to one or more of your chats so you can manage credits and billing from one place. Keep your phone, WhatsApp/Telegram, and website login secure: anyone with access can use your Street Cat credits. If you change phone numbers, contact us at contact@streetcat.app and we will transfer your account.

5. Free trial

New users may receive a free trial of 3 days. One trial per chat. At the end of the trial, the service pauses unless you purchase a plan. No payment details are required for the trial, and nothing is charged automatically.

6. Plans, credits, and payments

6.1 Plans. We offer subscription plans described at our pricing page and in your account shop: Free, Kitten, and Litter (with Colony coming soon), each including a monthly allowance of fish credits. Current prices and allowances are shown before every purchase.

6.2 Credits. Each reply the cat sends (text or voice note) consumes fish credits as described at purchase. Unused credits carry over while your subscription remains active, up to a balance cap shown in your account. Credits have no cash value and cannot be transferred or redeemed for money, except where refund rights apply (Sections 7–8).

6.3 Top-ups ("fish"). You may buy one-off top-ups of fish that add credits to your balance. These are added immediately, as described at purchase.

6.4 Payment. Payments are processed by Stripe via secure checkout links, either sent in chat or from your website account. We never see your card details. Prices include VAT where applicable. Subscriptions renew automatically, monthly — you will be reminded before each renewal and can cancel any time, from your website account Settings or by contacting us, with effect from the next period.

6.5 Price changes. We may change prices with at least 30 days' notice via WhatsApp/Telegram message or email. Changes never affect a period you have already paid for. If you don't accept a change, you can cancel before it takes effect.

7. Right of withdrawal (EU consumers)

If you are a consumer in the EU, you normally have a 14-day right of withdrawal from any purchase.

Because Street Cat is a digital service that begins immediately:

• When you purchase, you will be asked to expressly consent to immediate performance and acknowledge that, for one-off digital content (top-ups fully consumed), you lose the withdrawal right once fully performed.
• For subscriptions, you may withdraw within 14 days of purchase; we will refund the price minus a proportional amount for the service already used (based on credits consumed), as permitted by law.

To withdraw, email contact@streetcat.app or message the cat with REFUND within the 14-day period. We will confirm receipt of your request and process it — including calculating any proportional refund — within 5 business days.

8. Refunds beyond the withdrawal right

If the service materially fails to work (e.g. the cat stops responding for an extended period despite you having credits), contact us and we will fix it, extend your credits, or refund the affected amount — whichever you prefer within what the law provides. Statutory conformity rights for digital services under EU and Portuguese consumer law remain unaffected by anything in these Terms.

9. Acceptable use

You agree not to:

• use Street Cat for anything unlawful, or to harass, threaten, or harm anyone;
• attempt to make the cat produce sexual, romantic, or exploitative content — the cat will decline, and repeated attempts may lead to suspension;
• attempt to extract, reverse-engineer, or manipulate the underlying language model systems or prompts;
• use bots or automation to interact with the service, or resell access;
• infringe anyone's rights, including sending content you don't have the right to share.

We may suspend or terminate accounts that violate these rules. If we terminate your account for violation, unused credits from the current period are forfeited to the extent permitted by law; otherwise we refund unused amounts.

10. Intellectual property

The Street Cat service, characters, artwork, voices, and software are owned by us or our licensors. You get a personal, non-transferable right to use the service. You own the content of the messages you send us. Language-practice replies the cat sends you may be used for your personal learning freely.

11. Availability and changes to the service

Street Cat is an early-stage service. We aim for high availability but do not guarantee uninterrupted service; WhatsApp, Telegram, our language model providers, and hosting partners may cause outages beyond our control. We may improve, modify, or discontinue features. If we discontinue the service entirely, we will give at least 30 days' notice and refund unused paid credits.

12. Liability

Nothing in these Terms limits liability that cannot be limited by law (including for intent, gross negligence, or death/personal injury). Otherwise, our liability to you is limited to the amount you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect losses, or for decisions you make in reliance on AI-generated content.

13. Termination by you

You can stop using Street Cat at any time. To delete your account and data, message DELETE to the cat (WhatsApp or Telegram) or email us — see the Privacy Policy for details. This also cancels any active subscription (effective at the end of the period you've already paid for). Cancelling a subscription without deleting your account takes effect at the end of the paid period.

14. Complaints and disputes

• Support: contact@streetcat.app — we aim to reply within 2 business days.
• Livro de Reclamações: Portuguese consumers may submit complaints via the electronic complaints book at www.livroreclamacoes.pt.
• Alternative dispute resolution: consumers may use an ADR entity such as the Centro de Arbitragem de Conflitos de Consumo de Lisboa, without prejudice to going to court.

15. Governing law

These Terms are governed by Portuguese law. If you are a consumer, you also benefit from mandatory protections of the law of your country of residence, and you may bring proceedings in your local courts.

16. Changes to these Terms

We may update these Terms as the service evolves. Material changes will be announced via WhatsApp/Telegram or email at least 30 days in advance; continued use after that constitutes acceptance. If you don't agree, you may cancel and receive a pro-rata refund of unused paid credits.
